The 50% deposit is due prior to the session to lock in your session date. By signing this contract you are agreeing to pay the deposit to ensure your date.

By signing this contract you are agreeing to the following:

• No images or products shall be provided before payment is made in full. Remaining balance is due at the date of your session. Cash or checks are accepted. Session can also be paid in full in advance with cash or check and also Paypal.
• Cameras, including cell phone cameras, and recording devices may not be used during our session.
• If the subject is a minor I certify that I am legally able to give consent for the minor child.
• I agree that Megan Cross Photography may use such images with or without my name for any lawful purposes, including but not limited to publicity, illustration, advertising, and web content (for website, social media, etc.).
• Due to the artistic nature of custom photography all sales are final.

Model Release: Megan Cross Photography retains the copyright of all original images and reserves the right to use and reproduce them to promote her business including, but not limited to, website images and marketing displays.

Copyright: As a client of Megan Cross Photography, I understand that the images taken by Megan are protected by Federal Copyright Laws and that I will not make ANY copies or reproductions in any form (print or electronic) without the express written permission of Megan Mazza. Reproduction includes, but is not limited to scanning, downloading, right-clicking, e-mailing, posting on websites or blogs, photocopying, printing screen shots, or printing in any manner (without a print release). Sharing her work on social media sites is fine as long as her logo is not removed. Tagging Megan Cross Photography is also required. As an artist, Megan wishes to have complete control over the final look of her client's images, and scanned images damage her reputation as a photographer by distorting and devaluing the image quality. Thank you for respecting her work and livelihood by choosing not to reproduce her images.

This agreement details the terms and conditions of our engagement.
Please read through the following Release, Copyright and Policy information. By choosing "I Agree" you are agreeing to the terms and conditions of Megan Cross Photography.

Terms & Condtions:

Session Fee: The total payment is due the day of the session. A deposit of at least half can be made prior to the session date. Or full payment can also be made prior. If mailing a check, contact Megan for the address. Paypal links can be found on her website megancrossphotography.zenfolio.com/payment

Cancellations: If client shall cancel for reasons that are acceptable to the photographer, then the deposit will be refunded. No shows will be charged the full session fee and payment will be due within one week. Cancellations must be given either over the phone or through email, and must give at least two days notice, thus giving Megan time to make the appropriate new arrangements.

Exclusive Photographer: Photographing or videotaping is prohibited. Please do not bring your own camera, camcorder, or recording device to the session. (This includes cell phone cameras and video recorders.)

Client Usage: The client is obtaining prints for personal use only and shall not sell said prints or authorize any reproductions by parties other than the Photographer.

Social Media: The client is welcome to share the teasers Megan posts on her social media page but cannont do so without crediting the photographer by tagging Megan Cross Photography. Images cannot to altered in any way, included but not limited to the use of Instagram filters, crop out her watermark or applying their own edits.

Failure to Perform: If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to the Photographer’s illness, then the Photographer shall return the deposit but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or computer malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.

Print Care: Handle your prints with extreme care. Damage incurred as a result of improper handling, framing or hanging is the responsibility of the client. Clients are aware that the color dyes in photographic prints may fade or discolor over time due to their inherint qualilities.

*PLEASE NOTE: Monitors differ slightly in color, brightness, and contrast. PRINTS MAY NOT MATCH EXACTLY WHAT YOU SEE ON YOUR HOME COMPUTER. Each image is hand edited on Megan's professionally calibrated monitor and images from her professional lab will match her monitor for colors that are true to real life. The quality of photos printed at commercial printers such as Walmart, CVS or Walgreens are not guaranteed.

Sales are Final: Due to the personal nature of photography, all sales are final. However, should something not meet your expectations, it is your responsibility to contact Megan within one week and she will work to resolve the issue to your satisfaction.

Refunds: Please know that no refunds will be given if you consider your child to be uncooperative during your photo session. Megan will do everything in her power to work with you and your child to get smiles and laughter but as a parent herself, she knows that sometimes that's not possible. However, she will continue to photograph you and your child because these moments, the bad as well as the good, are real and represent true childhood. Cuddles with mom and dad are a great way to comfort an upset child and also make for beautiful photos, even if the child is not smiling at that moment. So don't be discouraged if you feel things went badly or that your child wasn't behaving "perfectly". Megan will do her best to get honest and beautiful photos of you and your child, no matter what. Reschedules can be offered at Megan's discretiion if a variety of things are not going well. But rest assured, that rarely ever happens.

Session Info:

It is strongly encouraged that clients arrive 5-10 minutes prior to the start of session. This allows for any last minute feeding, changing, and relaxing before session begins.

Please avoid eating or drinking red or orange food or drinks before session, as red and orange tend to leave a stain on the face.

The session will be one hour in length. Images will be available approximately 10-14 days from the session and will be presented to you in a password protected online gallery, with Megan's favorite images, which you are encouraged to share with friends and family at your own discretion. From there you will be able to order prints and other products using a simple ordering process.

If you purchase a USB of your digital photos, Megan Cross Photography is not responsible for any mishandling or loss of files from your computer or the drive.

Your gallery will be up for 6 months, which should give you time to make any decisions on how you choose to use your images. Within that time, you can reorder any of your files that you deem necessary.
